PRIVACY STATEMENT ON THE PROCESSING OF PERSONAL DATA

This privacy policy describes the processing of personal data collected through the site https://foresticollection.com/ (the “Website”) by Foresti Home Collection Group S.r.l., with registered office in Via G. Benzoni 31, 00154 Roma, VAT number 04412891006 (hereinafter “Foresti“).

Data controller

The data controller of the personal data of users collected through the Website (the “Data”) is Foresti.

Data collection methods

Data communicated by the users

Some areas of the Website require users to communicate personal data: in particular, when registering an account on the Website and subscribing to the newsletter service. The provision of such Data is voluntary: if users do not provide it, they may in any case browse the Website without benefiting from such features within the Website.

Data are collected if and to extent that they are communicated by users. The Data that are necessary is marked with an asterisk.

Users are invited not to communicate personal data of third parties to Foresti, unless it is necessary (e.g., because the user does not have her/his own email address and does not have other direct contact details): in this case, we remind you that it is up to the user to comply with legal requirements regarding the protection of personal data and, in particular to inform third parties of the communication and to obtain their consent, if necessary.

Purpose and legal basis of the data processing

Foresti processes the Data in compliance with the applicable data protection laws and with the instructions and provisions of the Italian Data Protection Authority.

Account registration and online shopping

The Data communicated by users in the “Register” section of the Website (including shipping and payment data) will be processed to allow the user to register an account on the Website, enter their favorite products in the wish list and, eventually, complete the purchase of the desired products. The processing includes:

1. statistical analysis relating to the products inserted in the wish list,
2. customer service activities,
3. sending of service communications on the status and the management of the order, including the shipment of chosen product,
4. the performance of legal obligations.

Such processing is necessary to perform a contract to which the data subject is party, to take steps at the request of a data subject and to comply with legal obligations. Any refusal by the users to provide their personal data will make it impossible to complete the purchase and account registration.

Newsletter subscription

The Data will be processed to enable the user to benefit from the newsletter service and, therefore, to send the newsletter concerning Forersti’s activities and the most important news related to it, its products, as well as trade fairs and event in which Foresti will participate (which will be sent by e-mail). This processing is based on the consent of the data subject.

Users may revoke their consent and request to unsubscribe from the newsletter service at any time, by sending a specific communication to Foresti at the addresses indicated in the “Users’ Rights” section, expressing their desire to unsubscribe from the service or following the procedure indicated at the bottom of the message received, pressing the “Unsubscribe” button.

The processing of Data for this purpose is optional: refusal to communicate the Data will only make it impossible for Foresti to send the newsletter to the user but will not preclude the possibility of browsing the Website, registering an account and/or making purchase.

Replies to contact requests and possible transmission of communications and commercial proposals

The Data will be processed to respond to requests that users may transmit by contacting Foresti at the addresses listed in the “Contacts” section of the Website. The Data may also be processed – in the event of interest of the users – to allow Foresti to send communications with commercial content, to set up meetings and possibly assess the opportunity to establish a contractual relationship.

The processing of Data is necessary for the purposes of Foresti’s legitimate interest in contacting users in order to provide them with assistance and information about its products. Such interest has been balanced against that of the users and is compatible with the reasonable expectation of the latter to receive a response to their requests. In addition, if the users have expressed such interest, the processing may be also be necessary to take steps at the request of a data subject.

In the event that the contact made by Foresti does not give rise to any pre-contractual relationship between Foresti and the user, it will still be possible for users to object to such processing, at any time, by writing to Foresti at the contact details indicated in the “Users’ Rights” section. In any event, any objection will not affect the lawfulness of the processing carried out to date by Foresti but will result in the deletion of all Data and the impossibility of fulfilling any pending requests.

The communication of Data for this purpose is voluntary but necessary: any refusal will make it impossible for Foresti to respond to requests received, providing information to the user, as well as making it impossible to establish any contractual relationship with Foresti.

Storage period of Data

With regard to registration of the account, the account will be deactivated if it is not accessed for a period of more than 36 months from the date of registration, If the user responds positively to the request that will be sent one month before the expiry date, the account will be kept active and retained for subsequent periods of 36 months.

In the case of purchases, Data will be kept for the period necessary to fulfil the tax, accounting and regulatory obligations related to the sale of Foresti’s products.

With regard to the processing of data for sending the newsletter, without prejudice to the user’s right to revoke their consent, the Data will be processed and stored for 48 months from the provision of the consent.

In relation to the processing of personal data for the purpose of responding to request received and sending proposals and commercial communications, the Data shall be kept for a maximum period of 12 months from the last contact. In the event that a contractual relationship is established between the user and Foresti, the Data shall be processed for the period indicated in the relevant privacy statement that shall be sent along with the contract.

Data will be kept for a longer period if this is necessary to comply with obligations established by law or to ensure the judicial protection of Foresti’s rights.

Recipients of Data

User’s Data, in relation to the purposes specified above, may be communicated to public authorities, where necessary to comply with legal obligations.

In case of purchases, the Data will be communicated to third party providers of ancillary services to online sales, such as shippers and carriers (for the shipping and delivery of purchased products) and banks (for the management of payments and refunds), based within the European Union.

For the purpose of sending the newsletter, the Data will be communicated to third party providers of newsletter services, based in Italy.

In addition, further recipients of Data are consultants and companies based in Italy that provide accessory and instrumental services to those provided by Foresti, such as, by way of example but not limited to, companies that provide Website management under the mandate conferred by Foresti.

The recipients of the data will process the Data, as the case may be, in their capacity as autonomous data controllers or data processors; in the latter case, these subjects will act by virtue of a specific written mandate given to them by Foresti.

Users’ Rights

At any time, users may:

1. Obtain access to the Data.
2. Obtain rectification or erasure or, where applicable, the restriction of the processing.
3. Object to the processing.
4. Withdraw consent.
5. Where applicable, receive in a structured, commonly used and machine-readable format, the Data provided to Foresti, as well as transmit such Data to another data controller without impediment from Foresti.
6. Lodge a complaint with the relevant Data Protection Supervisor Authority.
